Terms of Business
Trade Winds Fruit is committed to providing our customers some of the most difficult to find and exotic seeds fresh from harvest. We do not store seeds for excessive amounts of time and will send limited-viability seeds undried. We periodically test our seed stock and can attest to germination as we cultivate many of the plants ourselves from our own seeds. We do not send old seeds, known non-viable seeds, nor substitute seed selections under any circumstance without your prior approval. Our seeds have excellent germination records and we are proud to maintain as high possible standards in seed viability and selections. All seeds are for planting purposes only, and should not be consumed. We identify all plants and seeds to the absolute best of our abilities and take great care to make sure both species and varieties are sourced and identified correctly. Some species are similar in appearance and nature, and Trade Winds Fruit does not make any guarantee or hold any liability if germinated seeds show production, genotypic, or phenotypic differences from parent sources. Our tomato and pepper seeds are open-pollinated and as such, cross-pollination may sometimes occur. We offer no explicit warranty on any seeds but in most cases are happy to work with customers or provide replacements for seeds suspected of non-viability. Liability is always limited to the purchase price of the seeds only. In no event shall Trade Winds Fruit be liable for consequential damages, regardless of the nature, the cause, or the extent of loss. Your satisfaction is very important to us. Many tropical seeds have widely varying germination times. Please refer to our seed germination page for tips on germination and estimated germination times, or e-mail us with any further questions.
Trade Winds Fruit shall not be held liable for any damages, either direct or consequential from the use of our seeds.

Plant Use Notes
Do not under any circumstances ingest any plant or plant part that you do not have familiarity with. Our seeds are available for growing purposes only. Some seeds and plant parts are toxic if ingested and we recommend precaution with use and handling of seeds and plants you are unfamiliar with. We have labeled some plants toxic when appropriate. Always take proper precautions, e.g. gloves, washing, if handling seed species (from any source) that you are unfamilar with.
Weeds
A select very few plants may be classified as noxious weeds in a select few localities. We have tried to note this where possible. We do not supply known weed plants for sowing purposes to some areas. Please be mindful of your own plantings to control and stop the spread of local noxious weeds.
For All International Customers
Importing Note: By placing an order, you are taking full responsibility for importation of seeds into your home country and releasing Trade Winds Fruit from any liability related to shipments in-transit. Some countries, e.g. Australia, have strict regulations on which seeds are allowed to be imported. It is up to the buyer to obtain any necessary permits or documentation necessary for importation. Trade Winds Fruit is not responsible and there are no refunds for any loss of seed due to importation difficulties. While we do not anticipate any reduced viability or quality, seeds to destinations outside of the United States are sold AS-IS.
